Under Moroccan law, pre-trial detention is an exceptional measure: the principle is that the accused remains free until guilt is established. Yet many people spend weeks or even months in prison before trial. In Casablanca, Laamrani Law Firm prepares and argues applications for provisional release at every stage of the proceedings and in every type of case.
Is someone close to you in pre-trial detention? Call the firm, including on our emergency line +212 661-066-690. An application backed by the right documents from the first appearance is far stronger than one put together in a hurry.
It is the court decision releasing a person held in pre-trial detention pending trial, without any finding of innocence and without ending the prosecution. It may come with guarantees or obligations, and detention may also be replaced by judicial supervision.
The judge weighs the seriousness of the facts and the risk of flight or interference with the investigation against the guarantees the accused can offer. The application therefore rests on concrete elements: a stable, documented address, employment or business activity, family situation, no criminal record, health, time already spent in detention and, where relevant, weak evidence or procedural irregularities.
Provisional release may be made conditional on a financial or personal surety to secure the accused's attendance. The judge may also impose judicial supervision measures: a ban on leaving the country, surrender of the passport, regular reporting to a designated service, or a ban on contacting certain people. The lawyer proposes these measures where they can reassure the judge.
A release application is not a mere formality. Together with the family, we gather the evidence for each guarantee: lease or title deed, employment certificate or trade register extract, marriage and children's birth certificates, medical certificates, criminal record. We then argue the case before the judge in light of the facts of the file.
A refusal does not close the door. Orders of the investigating judge may be challenged under the conditions laid down by the Code of Criminal Procedure, and a fresh application can be made whenever something new arises: the end of the investigation, a favourable expert report, deteriorating health, the length of detention. For the earlier stage, see our Police custody page.
